font-weight: inherit;\">business relations between GH TECHNIQUE, artisan plumber (hereinafter<\/span><span style=\"font-style: inherit; font-weight: inherit;\">referred to as \u2018the Company\u2019) and its customers (hereinafter referred to as \u2018the Customer\u2019). They apply to all\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">quotations, offers, invoices and services relating to plumbing work,\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">sanitary facilities, heating and bathrooms.\u00a0<\/span><\/p><p><span style=\"font-style: inherit; font-weight: inherit;\">Any work commissioned implies unconditional acceptance of these GTC. The\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">Customer acknowledges having read these terms and conditions prior to signing the\u00a0<\/span><span style=\"font-style: inherit; font-weight: inherit;\">quotation or concluding the contract.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3baa90d elementor-widget elementor-widget-heading\" data-id=\"3baa90d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">ARTICLE 2 - QUOTATIONS AND OFFERS<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-886669a elementor-widget elementor-widget-text-editor\" data-id=\"886669a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li><strong>2.1 Preparation of the quotation<\/strong><\/li><\/ul><p>All quotations are provided for information purposes only and are not binding. The Company will conduct an on-site assessment before preparing a detailed commercial offer. Unless otherwise stated, quotations remain valid for 30 calendar days from the date of issue.<\/p><p><strong>2.2 Changes following the quotation<\/strong><\/p><p>During the initial visit, additional work or anomalies that were not initially visible may be discovered. In this case, the Company will draw up a supplementary quotation, which must be signed by the Customer before the additional work is carried out.<\/p><p>The Company reserves the right to modify the initial quotation in the event of technical difficulties arising during demolition or during the execution of the works, in particular :<\/p><ul><li><span style=\"font-style: inherit; font-weight: inherit;\">Presence of hazardous materials (asbestos, lead)<\/span><\/li><li>Necessary structural changes<\/li><li>Hidden defects revealed after opening<\/li><\/ul><p><strong>2.3 Inaccuracies related to access<\/strong><\/p><p>The Company cannot be held liable for additional costs resulting from difficulties in accessing the site, multiple staircases, or particularly difficult working conditions not initially mentioned.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-512d6dc elementor-widget elementor-widget-heading\" data-id=\"512d6dc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">ARTICLE 3 - PRICE CONDITIONS<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-55b6551 elementor-widget elementor-widget-text-editor\" data-id=\"55b6551\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>3.1 Pricing<\/strong><br \/>Prices are quoted in euros including VAT (all taxes included), unless otherwise stated. They include labour, travel and standard materials. Premium quality materials are charged at an additional cost according to the Customer's choices.<\/p><p><strong>3.2 Price increase<\/strong><\/p><p>The price agreed upon in the quotation is firm and final. However, in the event of :<\/p><ul><li>Increase in material prices of more than 10% between the date of the quotation and<br \/>the start of construction<\/li><li>Exceptionally extended lead times at the Customer's request<\/li><\/ul><p>The Company reserves the right to request a tariff review. Written justification will be provided to the Customer.<\/p><p><strong>3.3 Additional costs<\/strong><\/p><p>The following costs are not included unless expressly stated in the quotation :<\/p><ul><li>Removal of bulky items and rubble<\/li><li>Masonry, tiling or electrical work (if not mentioned)<\/li><li>Difficult access, working at height or in extreme conditions<\/li><li>Travel to remote locations (more than 50 km from Paris 17th arrondissement)<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d5fb61a elementor-widget elementor-widget-heading\" data-id=\"d5fb61a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">ARTICLE 4 - PAYMENT TERMS<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a360944 elementor-widget elementor-widget-text-editor\" data-id=\"a360944\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>4.1 Payment terms<\/strong><\/p><p><span style=\"font-style: inherit; font-weight: inherit;\">Payment shall be made in accordance with the terms and conditions set out in the quotation and invoice :<\/span><\/p><ul><li>50% deposit upon signing the quote (not mandatory for work under 300\u20ac)<\/li><li>Balance upon completion of work, prior to final acceptance<\/li><\/ul><p>Payment can be made by :<\/p><ul><li>Cash<\/li><li>Cheque<\/li><li>Bank transfer<\/li><li>Energy cheques (if applicable)<\/li><\/ul><p><strong>4.2 Payment period<\/strong><\/p><p>Payment of the balance must be made upon receipt of the invoice and no later than upon completion of the work. No additional work will be carried out if any outstanding payments remain.<\/p><p><strong>4.3 Invoice<\/strong><\/p><p>An invoice that complies with tax regulations will be issued to the Customer. It is payable on receipt.<\/p><p><strong>4.4 Default on payment<\/strong><\/p><p>In the event of default or delay in payment beyond 30 calendar days from the due date, the Company may :<\/p><ul><li>Suspend the execution of works<\/li><li>Charge late payment interest at the statutory rate (default interest)<\/li><li>Request reimbursement of all collection costs incurred<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a2f807a elementor-widget elementor-widget-heading\" data-id=\"a2f807a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">ARTICLE 5 - DELIVERY TIMES<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-50b8f8a elementor-widget elementor-widget-text-editor\" data-id=\"50b8f8a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>5.1 Work planning<\/strong><\/p><p>The deadlines are provided for information purposes only and do not constitute a binding commitment. The Company undertakes to meet the deadlines specified in the quotation as far as possible, depending on :<\/p><ul><li>Team availability<\/li><li>Weather conditions<\/li><li>Any additional work discovered<\/li><li>Delivery times for materials<\/li><\/ul><p><strong>5.2 Postponement of construction work<\/strong><\/p><p>The Company reserves the right to postpone a project in the event of :<\/p><ul><li>Extreme weather conditions<\/li><li>Reason of force majeure<\/li><li>Unavailability of the Client to access the site<\/li><li>Discovery of additional work<\/li><\/ul><p>The Customer will be informed as soon as possible.<\/p><p><strong>5.3 No penalty for late payment<\/strong><\/p><p>Failure to meet deadlines shall not give rise to any compensation, except in the case of a specific contract that formally includes penalties for late delivery.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-faf9741 elementor-widget elementor-widget-heading\" data-id=\"faf9741\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">ARTICLE 6 - LIABILITY AND WARRANTIES<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-520845f elementor-widget elementor-widget-text-editor\" data-id=\"520845f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>6.1 Compliance with standards<\/strong><\/p><p>The Company undertakes to carry out all work in accordance with :<\/p><ul><li>Compliant with current DTU (Unified Technical Documents) standards<\/li><li>To the applicable thermal regulations (RT 2020)<\/li><li>In accordance with applicable health and safety standards<\/li><li>To local regulations in Paris<\/li><\/ul><p><strong>**6.2 Guarantee of conformity<\/strong><\/p><p>The work is guaranteed to comply with the specifications and is accepted. This guarantee does not apply to defects resulting from misuse, lack of maintenance or external causes.<\/p><p><strong>6.3 Ten-year warranty<\/strong><\/p><p>The Company subscribes to a ten-year warranty covering the essential elements of the\u00a0<span style=\"font-style: inherit; font-weight: inherit;\">installations for 10 years from the date of acceptance of the works.<\/span><\/p><p><strong>**6.4 Two-year warranty<\/strong><\/p><p>A two-year warranty is provided on non-structural elements (taps, fittings) from the date of acceptance.<\/p><p><strong>6.5 Limitations of liability<\/strong><\/p><p>The Company's liability is limited to recognised and justified defects in conformity or performance. It does not include :<\/p><ul><li>Indirect damages (loss of earnings, loss of enjoyment)<\/li><li>Additional costs associated with repair by a third party<\/li><li>Damage caused by subsequent modifications made by the Customer<\/li><li>Normal wear and tear of materials<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b224a03 elementor-widget elementor-widget-heading\" data-id=\"b224a03\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">ARTICLE 7 - CUSTOMER OBLIGATIONS<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1123a7e elementor-widget elementor-widget-text-editor\" data-id=\"1123a7e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>7.1 Access to the construction site<\/strong><\/p><p>The Client undertakes to provide the Company with free and secure access to the work areas, as well as :<\/p><ul><li>Water supply when needed<\/li><li>Access to electrical installations (safety standards complied with)<\/li><li>A secure storage area for materials<\/li><\/ul><p><strong>7.2 Provision of information<\/strong><\/p><p>The Customer undertakes to provide all relevant information concerning :<\/p><ul><li>The layout of the premises<\/li><li>Existing facilities<\/li><li>Potential risks (asbestos, hazardous materials)<\/li><li>Condominium regulations, where applicable<\/li><\/ul><p><strong>7.3 Respect for the premises<\/strong><\/p><p>The Customer undertakes to:<\/p><ul><li>Protecting existing installations<\/li><li>Follow safety instructions<\/li><li>Ensure that third parties<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bfb5f87 elementor-widget elementor-widget-heading\" data-id=\"bfb5f87\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">ARTICLE 8 - RIGHT OF WITHDRAWAL<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c83590d elementor-widget elementor-widget-text-editor\" data-id=\"c83590d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>In accordance with current regulations, consumers have a period of 14 calendar days to withdraw, unless work has already begun at their express request. This right does not apply to :<\/p><ul><li>Contracts concluded on a professional basis (B2B)<\/li><li>Work commenced before the deadline<\/li><\/ul><p>In the event of exercising the right of withdrawal, the Customer shall bear any costs for work already carried out in accordance with the rates set out in the quotation.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b2d5511 elementor-widget elementor-widget-heading\" data-id=\"b2d5511\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">ARTICLE 9 - MATERIALS AND PRODUCTS<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3ce8765 elementor-widget elementor-widget-text-editor\" data-id=\"3ce8765\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>**9.1 Responsibility for materials<\/strong><\/p><p>The materials supplied by the Company are of recognised brands and standard quality. The Company is only liable for installation defects.<\/p><p><strong>9.2 Materials supplied by the Customer<\/strong><\/p><p>If the Customer supplies materials, the Company does not guarantee their quality or compatibility. It shall only be responsible for their correct installation. Any delay in the delivery of materials supplied by the Customer shall automatically extend the execution deadlines.<\/p><p><strong>9.3 Environmental standards<\/strong><\/p><p>The Company undertakes to use products that comply with environmental regulations. Certain products (paints, adhesives) may release volatile compounds; adequate ventilation of the site is necessary.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-583a0fc elementor-widget elementor-widget-heading\" data-id=\"583a0fc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">ARTICLE 10 - CLAIMS AND INSURANCE<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ace085c elementor-widget elementor-widget-text-editor\" data-id=\"ace085c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>10.1 Civil liability<\/strong><\/p><p>The Company is covered by professional liability insurance. The Client may request proof of this at any time.<\/p><p><strong>10.2 Bodily injury<\/strong><\/p><p>The Company shall not be liable for any physical injury sustained by the Customer or third parties during the performance of the work, except in the case of direct fault on the part of the worker.<\/p><p><strong>10.3 Property damage<\/strong><\/p><p>The Company undertakes to take all measures to protect the Customer's property. However, it can only be held liable for direct damage caused by its employees, within the limits of the insurance policy taken out.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b0c2729 elementor-widget elementor-widget-heading\" data-id=\"b0c2729\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">ARTICLE 11 - ADDITIONAL WORK<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-111aabf elementor-widget elementor-widget-text-editor\" data-id=\"111aabf\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>No additional work shall be undertaken without the Client's prior written consent. It shall confirm that the work has been carried out in accordance with the quotation.<\/p><p><strong>13.2 Reserves<\/strong><\/p><p>Any apparent defects must be reported upon receipt.
